Apply Battle backed by more online Giants Tech in FBI iPhone unlock battle

More of the biggest names in tech - including eBay, Google and Amazon have joined Twitter and AirBnB in backing Apple in its court battle with the FBI.

Apple supporters
The FBI has a court order demanding Apple helps unlock an iPhone used by the gunman behind the San Bernardino terror attack, Syed Rizwan Farook.

Farook and his wife killed 14 people in the California city last December before police fatally shot them.
Family members of some victims have backed the FBI's order.
Two groups of tech giants have now filed an amicus brief, which allows parties not directly involved in a court case, but who feel they are affected by it, to give their view.
Apple has appealed against the court order, arguing that it should not be forced to weaken the security of its own products.

Zuma tries to Sidestep Fallout with Climbdown

PRESIDENT Jacob Zuma’s lawyers on Tuesday asked judges of the Constitutional Court to avoid issuing an order that could be used for Mr Zuma’s impeachment after a huge climbdown on the Nkandla scandal.

The issue of whether President Jacob Zuma would pay back the money spent on upgrades to his Nkandla home has harmed both the African National Congress and Parliament. Picture: REUTERS/ROGAN WARD
The lawyers conceded that Mr Zuma was bound by Public Protector Thuli Madonsela’s directive that he pay back some of the R246m spent unnecessarily on upgrades to his Nkandla home.
By making the concession, Mr Zuma has, in a single stroke, wiped out the work of several official investigations and two parliamentary ad hoc committees that had exonerated him.

Breaking News: Drama as A-Court panel disagree over Saraki’s trial

SarakiOlubukola Saraki has created a sharp division among Appeal Court Justices.
Whereas Justice Moore Adumein dismissed the appeal that was lodged by Saraki as lacking in merit, another member of the panel, Justice ‎ J.E. Ekanem upheld the appeal, declaring the charge before the CCT as incompetent.

Justice Ekanem specifically quashed the charge and discharged Saraki on the basis that the Deputy Director at the Ministry of Justice, M. M. S. Hassan who signed the charge, did not specify who authorised him to initiate the ‎criminal proceeding.
“A look at the charge showed that Mr. Hassan instituted the action pursuant to section 24 of the Code of Conduct Bureau and Tribunal Act, 2004 which permits only the Attorney General of the Federation to initiate criminal proceedings”.

Google’s library survives lawsuit

A DECADE ago, Google announced plans to scan and make searchable the world’s books, and it has been fighting lawsuits from authors and publishers ever since.
After a seven-year legal battle, in 2012 the major US publishers reached a settlement with Google that allows them to keep copyrighted books from being displayed. On October 16, the US Court of Appeals for the Second Circuit upheld a lower court ruling in favour of Google and against the Authors Guild, meaning writers cannot stop the search giant from adding their work to its online library of more than 20-million books.

The saga has had enough twists and turns to fill a — well, you know.
"Google’s unauthorised digitising of copyright-protected works, creation of a search functionality and display of snippets from those works are noninfringing fair uses," Judge Pierre Leval wrote in the appellate decision.
Even though the company stands to profit from the project, its digital library is different enough and its excerpts limited enough in comparison with the original books that it does not need to license the material, Leval says.
