Heroin-abusing Queens lawyer’s roommate charged in fatal hammer beating: cops

The roommate of a heroin-abusing lawyer was charged with beating him to death with a hammer during a fight over drugs at their Queens home, police sources said Tuesday.

Jesse Smith, 29, was beaten to death with a hammer in his Astoria home after fighitng with his roommate over drugs, according to police sources.
Quentin Capobianco, 18, was charged with murder in the killing of his roommate, Jesse Smith, 29, the sources said.
Smith was attacked in their apartment on 21st St. near Astoria Blvd. in Astoria about 3:30 p.m. Monday, police said. He died at Elmhurst General Hospital.

The practicing lawyer had been struggling with a heroin habit, a police source said. Cops recovered a hammer and a shotgun from the apartment the two shared.
